Militant acquitted of Pearl murder to be moved to 'rest house'

The Sindh government had moved review petition before the Supreme Court before the telephonic conversation between Antony J. Blinken and Shah Mahmood Qureshi. The Indian government said the ruling was a "travesty of justice". Ahmed Omer Sheikh, the main accused, is a British national. During the hearing, Attorney General told the court that Ahmed Omer Shaikh is not a common criminal but is a mastermind of terrorists.

All detainees in the case should be brought to a general barrack of jail for two days and after it they should be kept at a government rest house, court said in its order.

The decision by the Supreme Court of Pakistan comes as the justices hear an appeal to reinstate the murder conviction against Ahmed Omar Saeed Sheikh, a Britain-born militant of Pakistani origin. The government will pay for his family's accommodation and transport. The court adjourned the case indefinitely.

Earlier, Supreme Court of Pakistan (SCP) on last Thursday ordered to release accused in case of murder of journalist Daniel Pearl.

He further told that a SIM which had United Kingdom number was recovered from Umer Sheikh in the jail, adding, with that number, he remained in contact with the terrorists.

Justice Sajjad Ali Shah asked, "Tell us, when did the detention order of Omar Sheikh end?" The provincial authorities argued that the third preventive detention order of Sept 28, 2020 was not violative of Article 2A, 4, 9, 10 (A), 14, 15 and 25 of the Constitution.

In such a case, law is clear that notice to the Attorney General must be issued under Order XXVII-A CPC. However, the court said in the rest house Omar Sheikh will not have access to the outside world.

"What is the basis for a stay order, it will be wrong to declare a person terrorist without any evidence", Justice Bandial remarked. The court said that after the Supreme Court order the detainees are entitled to be freed.

A three-member bench of the SC headed by Justice Mushir Alam announced the verdict with a 2-1 majority.

The US government has asked Pakistan government to ensure that those involved in murdering Pearl should be punished.

The family of USA journalist Daniel Pearl, who was kidnapped and beheaded in Pakistan in 2001, plans to appeal to Pakistan's Supreme Court to overturn a decision to free the four men convicted of his murder.

Mr Pearl disappeared on January 23 2002, in the port city of Karachi where he was investigating links between Pakistani militant groups and Richard C Reid, dubbed the "shoe bomber" after his attempt to blow up a flight from Paris to Miami with explosives hidden in his shoes. Al Qaeda's number three leader Khalid Sheikh Mohammed confessed to killing Pearl, and Sheikh, a former student at the London School of Economics, had played key role in luring the journalist into a trap.

The earlier ruling triggered outrage from Pearl's family and the U.S. administration.

"The release of these killers puts in danger journalists everywhere and the people of Pakistan".

Voicing outrage over the acquittal of Sheikh, the White House asked Pakistan to review its legal options, including allowing the United States to prosecute them to secure justice for Pearl's family.
